ORDERS
(a) An order placed by you on the Site for an item is only an offer by you to purchase an item for the price as displayed on the Site. Perfect Form Physiotherapy Pty Ltd reserves the right to accept or reject your offer for any reason whatever. Reasons may include, but are not limited to, the unavailability of an item or an error or change in the price displayed on the Site.
(b) All prices on the site are inclusive of GST which is a mandatory 10% Tax for Australian customers only. If you are not residing in Australia you will not be charged the GST and so the total amount charged will be less than advertised.
(c) Your contract with Perfect Form Physiotherapy Pty Ltd will only come into existence when Perfect Form Physiotherapy Pty Ltd advises you by email that it has accepted your order and confirmed receipt of your payment.
(d) Perfect Form Physiotherapy Pty Ltd does not guarantee that it will be able to make any changes, additions or cancellations to an order after it has accepted your order and it has confirmed receipt of your payment by email. However if an order has not been processed for delivery, change, additions or cancellations may still be possible. If an item you have ordered is temporarily out of stock, you will be contacted by email and informed of the expected delivery date. You will not incur any fee for this process.
WORKSHOPS
Cooling Off Period: If you advise us by notice in writing, via email within 7 days of placing the order that you do not wish to attend the workshop, we shall refund you all monies you have paid to us under this agreement. If a refund is due from us to you, we will process it within 30 working days.
Transferring Tickets: In the event that you are unable to attend the event you have booked and paid for, you can transfer your ticket to a nominated new attendee or attend the next edition of the event subject availability. To transfer the ticket you must notify us and provide us with the new participants full contact details at least 30 days before the event starts. The new attendee must also meet any relevant pre-course criteria as applicable at least 30 days before the event starts. An administration fee of $50 will apply. Transfer of tickets to another event may be arranged if the participant is prevented from attending due to a natural disaster on the day of the event.
Refunds: A full refund will be given out to the customer if Perfect Form Physiotherapy Pty Ltd cancels the workshop for any reason, however we will not be liable for any extra costs incurred – travel to the workshop, accommodation etc.
There will be no refund of fees after the cooling off period has expired unless due to extenuating services as outlined below.
- Pregnancy
- Contagious disease
- Major personal sickness, injury or major medical emergency
- Immediate family sickness or major medical emergency
- Participant is Deceased
There will be no refund of fees if the participant does not show up for any reason. Any alterations to your booking can only be made by emailing our office via info@theballetblog.com
DISCLAIMER OF LIABILITY
(a) Perfect Form Physio Pty Ltd does not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of the Site or any linked website, or which may arise directly or indirectly in respect of items supplied pursuant to an order placed on the Site. Perfect Form Physio Pty Ltd does not accept any responsibility for any such loss arising out of your use of, or reliance on, information contained on or accessed through the Site. (b) With regards to any loss or damage which may be suffered by you in connection with the purchase and use of any items supplied via the Site, Perfect Form Physio Pty Ltd, at its sole discretion, limits its liability to the extent permitted by law, and is fair and reasonable for Perfect Form Physio Pty Ltd to do so,Terms and Conditions to either repairing or replacing those items or paying the cost of having those items repaired or replaced.
OBSCENE AND OFFENSIVE CONTENT
We are not responsible for any obscene or offensive content that you receive or view from others while using our website. However, if you do receive or view such content, please contact us by e-mail to support@theballetblog.zendesk.com so that we can investigate the matter. Although we are not obligated to do so, we reserve the right to monitor, investigate, and remove obscene or offensive material posted to our website.
INDEMNIFICATION
You understand and agree that you will indemnify, defend and hold us and our affiliates harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, arising from your use of our website or your violation of these terms and conditions.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts in that State.

If any part of these terms and conditions of use are determined by a court of competent jurisdiction to be invalid or unenforceable, that part shall be limited or eliminated to the minimum extent necessary so that the remainder of these terms and conditions are fully enforceable and legally binding.
